Charleston SSDI Appeals Lawyer

Applying for Social Security Disability Insurance (SSDI) is known to be a difficult and time-consuming task. Everything must be completed perfectly before you can send the forms out in order to be approved. Once you’ve sent your documents in, there is still a good chance that your claim will be denied, requiring another long trek through the appeals process.

When your SSDI application is denied, there are four steps and deadlines you must follow for your claim to have a good chance of approval on appeal. To ensure the best hope of approval, you need the experienced Charleston SSDI appeals lawyers at Jan Dils, Attorneys at Law.

What Happens When My Claim Is Denied?

SSDI applications can be denied for almost any reason. Sometimes they even get denied because they were filled out incorrectly or the applicant missed a deadline. The appeals lawyers at Jan Dils have been through the process many times, and we know how to fix the issues and guide claims through the Social Security Administration.

There are four stages to filing an appeal once an SSDI claim has been rejected. When you come to us, we’ll be there for you through each stage of the process.

Request for Reconsideration

The SSA will send a letter of denial if they reject your claim. Claimants have 60 days to file a Request for Reconsideration and should come to us as soon as possible so we can start on their appeal.

Request for Hearing

It can take several months for SSA to respond to the Request for Reconsideration. If they approve, they apply the request retroactively. If not, the claimant must send a Request for Hearing. This informal hearing can take several months to schedule, depending on where in the country it is held.

Formal Hearings and Appeals

If the informal appeals are unsuccessful, you have two more legal steps to get your claim approved. These steps involve formal hearings before judges and administrators, so you must have legal representation.

Appeals Council of SSA

The administrative law judge should notify you within the following months if your request is approved. Otherwise, you must make a formal request to the Appeals Council.

Federal Court

If the SSA Appeals Council denies your claim, you can still make a final appeal to the federal circuit court in your district.

Can I Afford Legal Help?

At Jan Dils Attorneys at Law, we do not charge up-front fees for SSDI appeals cases. We take a percentage of the final award of benefits, and the federal government caps our fees at $9,200. However, if your case goes to a final federal appeal, a different fee structure applies without the traditional cap..
