Product Liability Lawsuit Updates

Product Liability Lawsuit Updates

Nobody expects their newly purchased product to cause them harm. Unfortunately, even if you use your new product as instructed, there is still a chance that you can be harmed by it. If this is the case, you may want to consider filing a product liability claim for the harm you suffered. The following are a few updates of ongoing or recently settled product liability cases that you might be affected by.

Prescription Medications and Supplements

Some of the most common types of product liability lawsuits are prescription medication and supplement lawsuits. One example is the class action lawsuits filed against Depo-Provera. While still in the early stages, lawyers are investigating how this injectable birth control has been linked to an increased risk of meningiomas. The plaintiffs in this case allege that the manufacturer, Pfizer, should have warned patients about the potential risk of developing harmful brain tumors.

Similarly, patients using popular GLP-1 medications such as Wegovy, Zepbound, and Ozempic, are suing each of the drug manufacturers after being diagnosed with gastroparesis. With no cure discovered yet, gastroparesis directly impacts the body’s ability to process food in the stomach and the small intestine, in turn completely changing the lives of those diagnosed with the condition.

Lastly, dozens of wrongful death lawsuits have been filed over the ingredient kratom, which is a Southeast Asian herbal supplement. It is typically used to treat pain, coughing, diarrhea, anxiety, and depression at home, but has also started to result in much more severe consequences, including death.

Herbicides

Herbicides like Roundup are well known for their link with certain life-threatening conditions such as cancer. More recently, though, plaintiffs have started to settle their lawsuits against manufacturers who use Paraquat, which is another lesser-known type of herbicide. People are bringing forward lawsuits alleging that the chemical increases an individual’s risk of developing Parkinson’s disease. To make matters worse, the herbicide has already been banned in multiple countries, just not in the U.S.

Asbestos

With countless ads warning of the risks of mesothelioma, it should come as no surprise that asbestos is one of the most common product liability claims in America. If you or your loved one is suffering from this deadly lung disease, there are mesothelioma “trust funds” set up by asbestos companies available for you to claim compensation. Likewise, if you are suffering from lung cancer, you may be entitled to compensation.

Baby Formula

Caring for a baby is stressful enough, but caring for a premature baby heightens a new parent’s stress. Hoping to provide the best care for their infant, many parents of premature babies feed them baby formula with a base of cow’s milk. Some examples of well-known brands that use this base are Smilac and Enfamil. Although this sounds like the best way to care for a preterm infant, it can actually put them at severe risk of developing a dangerous digestive disease known as necrotizing enterocolitis (NEC). With hundreds of lawsuits already pending, these baby formula companies are starting to be held accountable for the harm they are causing both new parents and their newborns.
