Protect Your Insurance Claim: What Not to Say at the Scene of the Accident
Jandils-Lady (1)

Being in a car wreck is incredibly distressing, and you are likely feeling shocked and confused. Regardless of the severity, it is good to call the police and medical services to make sure everyone is okay. It is natural to want to be helpful and provide as much information as you can. Unfortunately, in the commotion and chaos at the scene, you may inadvertently say something that could be detrimental to your insurance claim. So, while you should be exchanging contact information with the other driver and the police, there are some things you should avoid talking about until you have obtained a car accident lawyer.

To the Police and Other Driver

Do not say anything that can be interpreted as if the accident was your fault. Expressing concern and asking about everyone’s well-being is great, but that is about where it should stop. Sometimes even saying “I’m sorry” can be misconstrued as admitting fault.

The police have a job to do and they need to ask questions so they can fill out their report. Remember that you have no obligation to answer anything beyond “I do not know,” which is truthful because you actually do not know what happened. You only have your perspective. By no means should you say anything to suggest that you had been drinking or got distracted before the accident. The police can go through the proper channels if they want to follow up.

When Dealing with the Insurance Companies

Insurance is a business, and companies need to be mindful of their bottom line to stay in business. As such, insurance adjusters are likely going to ask you detailed questions about the crash, either at the scene or during a phone call. These questions are designed to get you to say something that can reduce their liability or completely shift the blame to you.

A representative of the company may even offer a lump sum after one call. Their goal here is to settle the matter as quickly as possible and at minimal cost, but it may not be enough to cover your basic medical treatment. That is why you should never agree to anything from the insurance company, including your own, without first talking to an attorney.
