How Much Back Pay Will You Receive?

We are never more happy then when we get our clients approved for SSI or SSDI. One of the first questions asked after the process is complete is: “How much back pay will I get?”

Social Security Backpay is given for payments you would have received had you been approved for Social Security at the onset of your disability.

SSI benefits begin accruing on the month following the month in which you became disabled and qualified for benefits. For example, if you became disabled on March 4, 2001, and if you applied for benefits on March 11, 2001, your first month of entitlement would be April 2001. If you were denied benefits until you went before an Administrative Law Judge in May 2003, you would receive back benefits from April 2001 until such time as your monthly benefit checks begin.

SSDI benefits begin accruing on the sixth month following the month in which you became disabled and qualified for benefits. For example, if you became disabled on March 14, 2001, and if you applied for benefits on March 21, 2001, your first month of entitlement would be September 2001. If you were denied benefits until you went before an Administrative Law Judge in May 2003, you would receive back pay going back to September 2001.

Your back benefits may be reduced if:

·        You have an attorney or other legal representative to assist you in securing your disability income. Although the SSA approved fee structure may change over time, as of this printing your legal representative is paid 25% of your back pay, not to exceed $6000. This fee is deducted from your back pay and sent directly to your legal representative.

·        You owe back taxes to the IRS.

·        You owe child support.

·        You owe federally-funded student loans.
