What are VA disability benefits?

VA Disability is a tax-free monthly benefit paid to Veterans who are at least 10% disabled because of injuries or diseases that were incurred in or aggravated during their time in the military.

  • A current diagnosis of a disability
  • A nexus (connection between your condition and service)

You can apply by submitting VA Form 21-526EZ through Veterans Affairs. Our office can also assist you with filing your claim

New and Supplemental Claims normally are processed in 6-12 months. If you enter the appeals process, it can take an additional 4-6 years depending on many factors.

Currently, it can take up to 4 years after an appeal is filed to receive a hearing in front of a Veterans Law Judge. Timelines are subject to VA discretion and may change.

Yes, unless you are pursuing Individual Unemployability. In that case, you must prove your service-connected disabilities prevent you from working.

Yes. A static rating means the VA will not schedule routine re-exams. However, if you file for an increase and undergo a new C&P exam showing improvement, the VA may propose a reduction. If you have held your rating for 20 years, it is protected. If a reduction is proposed, you can request a hearing.

The VA uses “VA math,” which does not simply add percentages together. New ratings are calculated based on your existing combined rating. A C-File (Claims File) includes all VA medical records, private records submitted to VA, past VA decisions, military medical records, military administrative records, and all evidence ever submitted in your claim history.
